Joshua’s story
Berenson Injury Law has successfully resolved the highly unusual case for a young man who was driving this commercial truck (the company’s name was deleted) in East Dallas last year.
The dump truck driver in front of Joshua stupidly activated the dump mechanism. As the bed raised, the top grazed a bridge which sheered off a piece of the truck. Our client swerved to avoid the road debris and a collision resulted. He was taken to a hospital and diagnosed with a strained back.
We immediately investigated the scene and obtained critical evidence that we needed to win the case.
We also researched the truck driver and his company and learned that he did not have a commercial driver’s license, but that he did have a criminal history.
And we found that the dump truck had also failed safety inspections and been placed out of service in the past under Federal Motor Carrier Safety Administration regulations.

How medical treatment and bills affect the value of a personal injury case

The issue of the amount of the injured person’s medical bills admissible in court has been one of the most difficult aspects of a personal injury case since the landmark 2011 Texas Supreme Court decision of Haygood v. De Escabedo, 356 S.W.3d 390). It held that if the plaintiff’s health insurance carrier, Medicare, Medicaid or another agency or party pays for their medical bills or some are written off, the at-fault driver gets credit. This reduces the financial value of the case.
The results
In addition, Joshua lost a week from his job and Mr. Berenson offered to give him a loan (and did not charge any interest – he has never charged interest in the past 40 years).
Our law firm continued to develop the case. We were then able to convince the truck company’s insurance carrier’s attorneys and representatives to pay an outstanding $160,000 — 13 times his medical bills — prior to trial. We then reduced Joshua’s medical bills and our legal fee.
Joshua was thrilled to receive $95,000 in his pocket. A team member drove his check to him Saturday morning.
