$400,000 Recovered in Fort Worth Truck Accident

Victory of the Month

As Tom was driving home from work, a tractor-trailer collided into his pickup as they turned left at an intersection.

He was rushed to the emergency room by ambulance. CT scans results were normal and he was discharged with the common strain/sprain diagnosis. He hired our law firm after he was jerked around by the insurance company, also common after a truck wreck.

Mr. Berenson, who has represented the injured victims of truck crash cases for almost 40 years, met with Tom and mapped out a strategy. He and his staff immediately investigated the scene and secured necessary evidence.

Mr. Berenson made the insurance company admit that its driver was at fault after it said it would not pay any money, arguing they had a statement from an adverse eyewitness and there was not much damage to the tractor-trailer.

Tom was badly injured. His shoulder was painful and Mr. Berenson referred his client to a doctor and paid for a Magnetic Resonance Image which showed a partial tendon tear.

Mr. Berenson referred Tom to a top orthopedic surgeon who did additional testing that confirmed that an arthroscopic surgery was necessary. However the surgery was not successful and a second procedure had to be performed. He could not work.

As Tom went through physical therapy and recovered, our office gave him interest-free loans and guaranteed medical bills that were not covered by his health insurance. His medical bills were reduced by the liability insurance company under the “paid vs. incurred” statute and cases that legally write down medical bill balances after health insurance payments.

Mr. Berenson successful resolved Tom’s case for seven times the insurance company’s first offer before trial. He then reduced Tom’s outstanding medical bills, health insurance and disability reimbursements, and his fees and expenses to get more money for his client. Tom’s recovery after expenses were paid was $196,000.

Tom was delighted with our work and very nicely wrote this review:

“I had a great experience & relationship with Mr Berenson. I felt well represented & was kept informed with any development’s pertinent to my case. I would definitely use him again if needed. He fights for his clients 100%. Thanks Mr Berenson for everything you did for my wife & myself.

We are glad that Tom has recovered. It was a privilege to represent him and his wife, whom we are also representing in her own car crash case.
