How Much Is An Injury Case Worth?

After a serious injury, the first concern is obviously getting the appropriate medical treatment in order to get back to 100%. However, after hiring an attorney to look after your legal rights, many clients wonder how much their particular case is worth. Unfortunately, the answer is complicated.

There are several factors that determine the value of a case, including: the amount of your medical bills, the conduct of the defendant, whether you are suing an individual or a company, the likeability of the Plaintiff, the claimant’s lost earnings, and the permanency of the injury. As you can see in the list above, it can be difficult to predict the value of a case until a complete investigation has been performed.

For instance, let’s say that there is $100,000.00 worth of available insurance money after a serious injury. In this example, we’ll say the injury is permanent, there is a corporate Defendant, and your medical bills are $70,000.00. However, if we are instead suing an individual, the injuries completely heal after 3 months, and your medical bills are $7,000.00, then instead of the maximum amount of insurance available ($100,000.00), a potential settlement for this claim would be significantly less.

Keep in mind, though, that these numbers aren’t accurate for every single case.
